ORDER

The present Petition has been filed by the sole accused in C.C.No.223 of 2023 on the file of the Judicial Magistrate Court, Paramakudi, Ramanathapuram District, seeking to quash the charge sheet in C.C.No.223 of 2023 on the file of 1/4

the Judicial Magistrate Court, Paramakudi, Ramanathapuram District, wherein, the Petitioner has been charge sheeted for the offences under Sections 279 and 304(A) of IPC.

2.A perusal of the chargesheet reveals that the petitioner had driven a car in a rash and negligent manner and dashed behind the cycle, which the defacto complainant's father was riding and thereby, causing a fatal accident. 3.The learned counsel appearing for the petitioner submitted that the ingredients of the offence have not been made out and therefore, the charge sheet may be quashed.

4.Heard both sides and perused the material records. 5.A perusal of the charge sheet reveals that the prima facie has been made out as against the petitioner and therefore, this Court is not inclined to interfere at this stage especially when no legal grounds have been raised for quashing the charge sheet.

6.The trial Court is directed to dispose of the case on merits without being influenced by any one of the observations made by this Court. Considering the age of the petitioner, the personal appearance of the petitioner herein is dispensed with unless specifically directed by the trial Court. 7.With the above said observations, this Criminal Original Petition stands dismissed.
