ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 354(A), 323, 509 of I.P.C., r/w. Section 4 of Tamil Nadu Prohibition of Women Harassment Act in Crime No.49 of 2016 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.sdide).
3. The case of the petitioner is that the petitioner went to the village to attend the temple festival and he has been foisted with the false case for the alleged incident said to have been taken place on 20.10.2016 as there is a delay in complaint, the so called incident made on 21.09.2016. According to him, there is no reason for making the complaint belatedly and there is a dispute between the family members, he has been falsely implicated in this case.
4. The case of the prosecution is that even though the incident has taken place on 21.09.2016 that the accused has misbehaved with the girl, as there was an attempt to resolve the issue between the parties, mediation took place ultimately, it was failed and hence, the de-facto complainant has lodged the complaint. https://hcservices.ecourts.gov.in/hcservices/
5. Since the serious offence said to have been committed by the petitioner more particularly attracting Section 354(A), this Court is not inclined to grant anticipatory bail. Hence, this petition is dismissed.
