PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 1st Respondent to transfer the investigation of the petitioner's complaint dated 04/10/2022 from the file of the 2nd Respondent to some other agencies for other reliefs within the time stipulated by this Court.

ORDER

This Criminal Original Petition has been filed to direct the 1st Respondent to transfer the investigation of the petitioner's complaint dated 04/10/2022 from the file of the 2nd Respondent to some other agencies for other reliefs within the time stipulated by this Court.

2. The learned Additional Public Prosecutor would submit that on the basis of the complaint given by this petitioner, enquiry was undertaken in C.No.G3/2022 and C.No.319/2022. During the course of enquiry, both the parties appeared and the counter parties gave a statement that they will return the amount in a scheduled manner and the last schedule was admitted that 10.11.2022.

3. Now the grievance of the petitioner is that even after the above said undertaking, that was not complied by the private respondents by returning the amount.

4. It appears that the closure report dated 13.10.2022 is not sent to the petitioner, even though the petitioner sent reminder on 22.02.2023. If the petitioner shows that there is violation of undertaking by the above said private respondents, the petitioner is at liberty to give a fresh complaint before the second respondent.

5. With the above said liberty, this Criminal Original Petition is disposed of.
