ORDER

This Criminal Original Petition has been filed to direct the 1st respondent to withdraw the investigation of the case in Crime No.42 of 2023, from the file of the 3rd Respondent and transfer it to any other competent investigation officer and further direct such officer to file a final report/charge sheet within the time fixed by this Court.

2. Now the grievance of the petitioner is that even though the First Information Report was registered on 26.01.2023, so far no proper investigation has been conducted.

3. The learned Additional Public Prosecutor would submit that it is the dispute over the rental agreement between the parties. Investigation has been undertaken, so far nine witnesses have been examined. The investigation is almost over.

4. In view of the above said development, there is no question of transfer of investigation at this stage and this Criminal Original Petition is disposed of, by directing the 3rd respondent to complete the investigation within 1 month from the date of receipt of a copy of this order.
