O R D E R
When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that on the basis of the complaint given by the fourth respondent, an enquiry was undertaken in C.No.120 of 2023. During the course of enquiry, both the parties appeared before the Enquiry Officer and the petitioner has given a statement that she will pay the entire amount within a month and if any failure is noticed, she is ready to face any steps taken by the fourth respondent. On the basis of the said undertaking, the enquiry was closed.
2. The grievance of the petitioner is that only through Meenakshi the said loan amount was received. A reading of the statement of the petitioner shows that the property was mortgaged by the petitioner to the above said 5th respondent and only on the basis of the mortgage, loan was given. Already undertaking was given by the petitioner. If the petitioner is not amenable to the undertaking, the fourth respondent can workout 2/4
her remedy before the appropriate forum.
