This Criminal Revision has been filed under section 397 r/w 401 of Criminal Procedure code, to set aside the order in Cr.M.P.No.1223 of 2019 on the file of the Principal Sessions Judge, Karur, dated 21.10.2019 in Crime No.130 of 2019 on the file of the Inspector of Police, Vangal Police Station, Karur District. Consequently direct the Principal Sessions Judge, Karur,to hand over the interim custody of the vehicle bearing registration No.TN-47-U0585 (Ashok Leyland Multi Axle Goods ) to the petitioner and pass such further or other order and may deem fit in the facts and circumstances of the case.
ORDER:- This Criminal Miscellaneous petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.S.Gokulraj, Advocate for the Petitioner and of Mr.S.Chandra Sekar, Additional Public Prosecutor for the respondent, this Court made the following order:
Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State. 2.The learned counsel for the petitioner states that due to financial constrain and COVID-19 situation, the petitioner was not able to deposit a sum of Rs.50,000/- in the credit of Crime No.130 of 2019, on the file of the Principal Sessions Judge, Karur, within the time stipulated by this Court, in its order dated 20.02.2020 as a pre-condition for release of the vehicle bearing Regn.No.TN-47-U0585, Ashok Leyland Multi Axle Goods. to deposit a sum of Rs.50,000/- and get back the interim custody of the vehicle.
3.Taking into consideration the submission made by the learned counsel for the petitioner, time is extended for complying the conditions imposed in Crl.R.C.(MD)No.183 of 2020 till 15.07.2020. The Court below shall ascertain the ownership of the vehicle, verify the original RC of the vehicle and thereafter, act upon the orders passed by this Court.
