9.M.Hitler 10.P.Paulraj 11.R.Celladurai 12.S.Devaki : Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the third respondent in Na.Ka.No.1465/A1/2021, dated 16.03.2021 and quash the same and consequently, cancel the impugned settlement deed, dated 24.03.2010 in document No.1444 of 2010 executed by Late.Muthukutty in favour of 7th respondent herein as non-est, including all subsequent deeds bearing Document Nos.3468, 3469, 3470 of 2017 4509 of 2019 and 1736 of 2021 executed by the respondents 7 to 12 on the file of the fourth respondent and consequently, direct the fourth respondent to remove the entry of settlement deed in document No.1444 of 2010, dated 24.03.2010 and all the aforesaid consequential deeds, from their records. The Writ Petition is directed against the impugned proceeding of the third respondent in Na.Ka.No.1465/A1/2021, dated 16.03.2021 and consequently, cancel the impugned settlement deed, dated 24.03.2010 in 2/5
document No.1444 of 2010 executed by Late.Muthukutty in favour of 7th respondent herein as non-est, including all subsequent deeds bearing Document Nos.3468, 3469, 3470 of 2017 4509 of 2019 and 1736 of 2021 executed by the respondents 7 to 12 on the file of the fourth respondent and consequently, direct the fourth respondent to remove the entry of settlement deed in document No.1444 of 2010, dated 24.03.2010 and all the aforesaid consequential deeds, from their records
2. When the matter is taken up for hearing today, the learned counsel appearing for the writ petitioner would submit that the matter is settled between the parties and as such, the prayer sought for by the petitioner in the writ petition has become infructuous.
