This criminal original petition has been filed seeking transfer of investigation in crime No.385 of 2023, from the file of the third respondent to any other investigating agency.

2.The learned Counsel appearing for the petitioner submits that the petitioner is an accused in Crime No.385 of 2023. 3.The case of the petitioner is that the petitioner has been foisted with a false complaint. According to the petitioner, at the time of occurrence, he was at Valliyoor Police Station, which he also disclosed to the respondent police and the respondent police without considering the same is proceeding with the investigation.

4.The learned Government Advocate (Crl.Side) submits that the investigation in Crime No.385 of 2023 is already completed and a final report is also filed before the learned Judicial Magistrate, Valliyoor and the same is taken on file, in S.T.C.No.629/2023, for the offences under Section 291 IPC.

5.Recording the submission of the learned Government Advocate (Crl.Side), this criminal original petition is closed with a liberty to the petitioner to challenge the final report.
