PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned Advertisement No. 01/KKNPP/HRM/2018 dated Nil issued by the fifth respondent and quash the same as illegal and consequently direct the respondents to fill up the C Category posts in the Kudankulam Nuclear Power Project by giving priority to the legal heirs of land acquisition affected persons and local youth of Kudankulam strictly in accordance with the proceedings in Na.Ka.No.C3/2054/98 of the 2nd respondent dated .03.1999 read with minutes of the Peace Meeting Resolutions in Na.Ka.No.A2/814/2024 dated 02.03.2024 issued by the third respondent before conducting any examination for 'B' category posts.

ORDER

This writ petition has been filed challenging the advertisement No. 01/KKNPP/HRM/2018 issued by the fifth respondent proposing to fill up 'B' and 'C' category posts in the fifth respondent, Nuclear Power Corporation of India Limited on the ground that the Project Affected Persons are required to be accommodated at the first instance before resorting to recruitment through advertisement. In response to the notice 2/5

issued by this Court, the respondents 4 and 5 filed their counter affidavit contending that the petitioner is not possessing the requisite qualifications for considering his claim for being appointed either to the Category ''B'' or to the Category ''C'' posts, which are subject matter of the impugned advertisement.

2. The case set up by the petitioner appears to be unsustainable for want of necessary qualifications and the challenge to the impugned notification cannot be sustained. The fact that the petitioner does not possess the requisite qualifications is not disputed by the learned counsel for the petitioner.

3. This Court does not see any reason to do any academic exercise in the present matter and all the issues that are raised in the present reputation are left open. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 01.06.2026 CM 3/5
