PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the 1st respondent herein to pass appropriate orders on the proposal forwarded by the 3rd respondent seeking relaxation of the relevant service rules for the petitioner in light of his representation dated 24.06.2025 for fixation of seniority on par with his junior and for grant of consequential promotion to the post of Block Development Officer, including monetary and service benefits within a time frame to be fixed by this Court and in any event before the petitioner attains the age of superannuation. Mr.S.Shaji Bino, learned Special Government Pleader, takes notice for the respondents.

2. With the consent of both sides, this writ petition is disposed of at the admission stage.

3. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents.

4. It is the case of the petitioner that he was initially appointed as Junior Assistant on compassionate grounds and due to procedural and administrative delay, his probation could not be declared immediately thereafter on par with the other similarly situated persons. Because of the said reason, the Junior Assistants, who were juniors to the petitioner, have marched over to him and got further promotion to the post of Deputy Block Development Officer, Block Development Officer etc. However, after declaration of his probation in the post of Junior Assistant, the petitioner made a claim for restoration of his seniority on par with his juniors and accordingly, proceedings dated 09.11.2021 have been issued restoring the seniority of the petitioner in the cadre of Deputy Block Development Officer.

However, his further promotion to the post of Block Development Officer has not been considered on par with his juniors for want of acquiring certain service qualifications. Therefore, the petitioner submitted a representation dated 24.06.2025 to the respondents seeking relaxation of the said service qualifications and for considering his case on par with his juniors.

complaining against the non-consideration of the said representation dated 24.06.2025, the petitioner has approached this Court by filing the present writ petition.

5. Learned counsel for the petitioner submits that under similar circumstances, the Government has granted benefit of exemption in favour of certain other candidates, vide G.O.(P) No.80, Rural Development and Panchayat Raj (Pa.A.6) Department, dated 19.02.2026.

Learned Special Government Pleader appearing for the respondents, on instructions, submitted that in case the representation dated 24.06.2025 submitted by the petitioner is still pending consideration, the same would be considered and appropriate orders would be passed by the first respondent expeditiously.

In the light of the above, without going into the merits of the matter, this writ petition is disposed of directing the first respondent to consider the representation dated 24.06.2025 submitted by the petitioner and pass appropriate orders thereon, duly taking into consideration the Government Order issued under the similar circumstances, as expeditiously

as possible, at any rate, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
