ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent. 2.The petitioner, who apprehends arrest at the hands of the respondent Police, for the alleged offences punishable under sections 379 IPC r/w 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, seeks anticipatory bail. 3.The case of the prosecution is that the petitioner along with other accused has illegally transported one unit of river sand by using a Bullock Cart. Hence, this complaint.
4.The learned counsel appearing for the petitioner submits that earlier application filed by the petitioner along with other accused was dismissed by this Court on the ground that three previous cases are pending against the petitioner. He further submits that out of three previous cases, two cases were under Tamil Nadu Prohibition Act and the same was also closed by paying the fine amount. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.7267 of 2022 5.The learned Government Advocate submits that earlier applications filed by the petitioner were dismissed by this Court, on the ground that the petitioner is having three previous cases pending against him and there is no change in circumstances. 6.It appears that the application filed by the petitioner is without referring the change of circumstances to consider the case. Since there is no change in circumstances, after the dismissal of earlier petition, this Court is not inclined to grant anticipatory bail to the petitioner.
