PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorari, calling for the records relating to the impugned order passed by the 2nd respondent in his proceedings R.C.No.1220274/AP II(3)/2021 dated 04.09.2021 confirming the impugned order passed by the 3rd respondent in his proceedings C.No.A4/3231/AP/2020 R.O.No.128/2021 dated 16.03.2021 confirming the punishment order passed by the 4th respondent vide his proceedings in C.No.F.3/T.P.38/2016 dated 19.03.2020 and quash the same as illegal.

ORDER

The writ petition has been filed for issuance of Writ of Certiorari, to call for the records relating to the impugned order passed by the 2nd respondent in his proceedings R.C.No.1220274/AP II(3)/2021 dated 04.09.2021 confirming the impugned order passed by the 3rd respondent in his proceedings 2/6

C.No.A4/3231/AP/2020 R.O.No.128/2021 dated 16.03.2021 confirming the punishment order passed by the 4th respondent vide his proceedings in C.No.F. 3/T.P.38/2016 dated 19.03.2020 and quash the same as illegal.

2. Heard Mr.S.Mohamed Suhail, learned counsel appearing for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondents.

3. By consent of both parties, this writ petition is taken up for final hearing at the admission stage itself.

4. The petitioner, who was working as Junior Assistant in the fourth respondent office, has been removed from service in pursuant to the disciplinary action initiated against him.

5. Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondents submitted that the appeal filed by the petitioner has also been dismissed. The petitioner has been given with the charges that he had 3/6

misappropriated public money by conducting a Deepavali Chit fund along with his wife. In this regard, a criminal case has also been registered and the same is said to be pending. He further submitted that the petitioner has filed revision petition on 20.08.2022 to the Government which is pending for consideration.

In such case, it is appropriate to direct the first respondent to dispose the revision petition and accordingly, the first respondent is directed to dispose the revision petition filed by the petitioner dated 20.08.2022 within a period of eight weeks from the date of receipt of a copy of this order.

7. With the above direction, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petitions are closed. 02.04.2024 Index : Yes / No Internet : Yes / No NCC : Yes / No PJL 4/6
