PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to take immediate action to remove the encroachment as well restore the cart track in S.Nos.226/19, 202/2 and 224/1 in Keezhappatti, Kodumbalur Village, Viralimalai Taluk, Pudukkottai District within a time as may be fixed by this Court. For Petitioner : Mr.A.Mohan For R1 to R3 : Mr.VR.Shanmuganathan, Special Government Pleader.

ORDER

(Order of the Court was made by M.V.MURALIDARAN, J.) The petitioner seeks for a Writ of Mandamus, directing the respondents 1 to 3 to take immediate action to remove the encroachment as well as to restore the cart track in S.Nos.226/19, 202/2 and 224/1 in Keezhappatti, Kodumbalur Village, Viralimalai Taluk, Pudukkottai District.

2.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader, who takes notice on behalf of the respondents 1 to 3. By consent of both parties, the writ petition is taken up for final disposal at the stage of admission itself.

3.The petitioner had already given a representation dated 21.12.2017 and based on his representation, the Revenue Divisional Officer, Ilupur, by letter dated 08.01.2018, directed the second respondent / Tahsildar, Viralimalai Taluk, Pudukkottai District to take action on the representation of the petitioner dated 21.12.2017. But, no action was taken by the second respondent. Therefore, the petitioner has given another representation on 02.04.2018 and third representation on 21.05.2018. Though the petitioner has given representations on three occasions, the respondents 1 to 3 did not take any action on the representations of the petitioner.

4.In the above circumstances, we are inclined to pass the following order:- (a) This writ petition is disposed of;

(b) The respondents 1 to 3 are directed to consider the petitioner's representations dated 21.12.2017, 02.04.2018 and 21.05.2018 and to pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
