Respondent Prayer:- Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent not to interfere into the civil dispute in respect of the petitioner's absolute possession and enjoyment over the property in S.Nos.195/2A, 195/4A and 195/5A and his wife's Patta No.1811 in respect of the property in S.No.195/2B and 195/4B situated at Devarkulam Village, Sankarankovil Taluk, Tirunelveli District.

ORDER

This Writ Petition has been filed seeking for the issuance of Writ of Mandamus, directing the respondent not to interfere into the civil dispute in respect of the petitioner's absolute possession and enjoyment over the property in S.Nos.195/2A, 195/4A and 195/5A and his wife's Patta No.1811 in respect of the property in S.No.195/2B and 195/4B situated at Devarkulam Village, Sankarankovil Taluk, Tirunelveli District.

2. Heard the learned counsel appearing for the petitioner and also the learned Additional Government Pleader appearing for the respondent.

3. Alleging that the respondent is interfering with the civil dispute, the present Writ Petition has been filed.

4. The learned counsel for the petitioner has submitted that the property in question is belonged to the petitioner and he is possession of the property for the 40 years. He further submitted that the respondent is unnecessarily interfering with the civil dispute.

5. The learned Additional Government Pleader has submitted that a complaint has been given by one Shanmuga Thevar, based upon which,a statement has been given by the petitioner, stating that no objection to measure the said property. Accordingly, the complaint was closed.

6. The learned counsel for the petitioner has also submitted that there is no objection for measurement of the property along with the surveyor.

7. Since there is no interference by the respondent, over the said property of the petitioner and also the fact that the complaint was also closed. Accordingly, the Writ Petition shall stands closed. No costs.
