Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KARTHICK.P, Advocate for the petitioner and of MR.A.THIRUVADIKUMAR, Additional public prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the conditions imposed on the petitioner in Crl.M.P.(MD)No.6980 of 2023 on 13.03.2024.
2. The learned counsel for the petitioner submitted that the petitioner did not have any blood relatives and hence, he prayed to modify the condition as regular sureties instead of blood sureties. He further submitted that the petitioner is residing at Orathanadu Taluk and hence, it is difficult for him to sign two times in a day before the Court and hence, he prayed to sign once in a day.
3. Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor appearing for the respondent submitted that he has no objection to modify the conditions as prayed for by the petitioner.
4. Considering the submissions of the learned counsel on both sides, the condition Nos.(i) & (iii) imposed by this court in Crl.M.P.(MD)No.6980 of 2023 on 2/4
13.03.2024 is modified to the effect that the petitioner shall execute a bond for a sum of Rs.25,000/- with two regular sureties each for a like sum to the satisfaction of the learned Sessions Judge, Sessions Court for Exclusive Trial of Cases under POCSO Act, Thanjavur and the petitioner shall appear and sign before the concerned Court daily at 10.30 a.m., till the disposal of the appeal. sd/- 27/03/2024 / TRUE COPY / 01/04/2024 Sub-Assistant Registrar (C.S.)
