PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent for attachment and sale of the identified properties mentioned in the representation, dated 03.02.2025 that belong to the partners of the said three financial establishments under Sections 3 and 7 of TNPID Act. This Writ Petition has been filed seeking a direction to the first respondent for attachment and sale of the identified properties mentioned in the representation, dated 03.02.2025 that belong to the partners of the said three financial establishments under Sections 3 and 7 of TNPID Act. 2.According to the petitioner, he is the one of the depositors in the Sivaparvathi Financiers, Sri Geethanjali Auto Financiers and SG Finance. While so, some of the properties of the above said finance 2/6
companies were already attached, but those properties are not sufficient for the due pending to the depositors. Now, the petitioner found some properties in the name of the above said finance companies and the details of the same were sent to the respondents for taking steps to attach the properties through representation dated 03.02.2025, but the same has not been considered. Hence this petition.
3.The learned Additional Public Prosecutor appearing for the respondent police would submit that already the properties of the financiers were attached and now, they are also taking steps to attach some other properties, which were identified by the petitioner and others. The petitioner's representation is under consideration and the same will be enquired and appropriate steps will be taken in accordance with law to attach the properties through the authorities concerned. 4.Since the prayer of the petitioner is to consider his representation and to attach the properties, the fourth respondent also taking steps to attach the properties based on the petitioner's representation, the fourth respondent is directed to enquire the matter and take appropriate steps, within a period of two months from the date of this order in accordance 3/6
with law.
