ORDER : The Court made the following order :- The petitioners/accused, who apprehend arrest at the hands of the respondent police in Crime No.Not Known of 2026 for the offences punishable under Sections 117(2) & (4), 118, 296, 318 and 351 of the Bharatiya Nyaya Sanhita, 2023, seek anticipatory bail.

2. The case of the prosecution is that on 01.03.2026, the petitioners abused the defacto complainant and wrongfully restrained him from using the pathway and from driving his two-wheeler, which led to a quarrel. Hence, the above case has been registered for the aforesaid offences.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and that they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners would abide by any conditions that may be imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the enquiry is pending at the C.S.R. stage from 04.03.2026 and, therefore, objected to the grant of anticipatory bail to the petitioners.

5. This Court heard the learned counsel on either side and perused the materials placed on record.

6. Considering the facts and circumstances of the case, the respondent police is directed to conduct the enquiry and, if any prima facie case is made out against the petitioners, to register an F.I.R., or otherwise close the petition enquiry, within a period of 15 days from today. Till such time, the petitioners shall not be arrested by the respondent police.

7. In the result, this Criminal Original Petition is disposed of accordingly.
