PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachment made by the 4th respondent to the public pathway as per the petitioner's representation dated 09.05.2018. For Petitioner : Mr.H.Velavadhas For R1 to R3 : Mr.C.Ramar, Additional Government Pleader.

ORDER

(Order of the Court was made by M.V.MURALIDARAN, J.) The petitioner seeks for a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachment made by the 4th respondent to the public pathway as per the petitioner's representation dated 09.05.2018.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader, who takes notice on behalf of the respondents 1 to 3. By consent of both parties, the writ petition is taken up for final disposal at the stage of admission itself.

3.Though the petitioner has stated that the petitioner has given a representation on 09.05.2018, there was no proof to show that the said representation has been served to the respondents. Therefore, the petitioner is directed to give a fresh representation to the respondents 1 to 3, within a period of one week from the date of receipt of a copy of this order. representation, the respondents 1 to 3 are directed to consider and pass appropriate orders on merits and in accordance with law, within a period of three months thereafter.

4.With the above directions, the Writ Petition stands disposed of. No costs.
