For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the petitioners on bail in the event of their arrest in connection with Cr.No.765 of 2020, on the file of the Ammapet Police Station, Thanjavur District.

ORDER : The Court made the following order :- The petitioner, who is arrayed as A2, apprehending arrest at the hands of the respondent police for the offences punishable under section 379 of IPC and Section 21(4) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.765 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. The https://hcservices.ecourts.gov.in/hcservices/

CRL OP(MD). No.6701 of 2020 petitioner is not having any bad antecedent and hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there are fifteen previous cases pending against the petitioner and he is a habitual offender.

5. This is the second application and there is no change of circumstances to entertain this application. Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate(Criminal Side) that there are fifteen previous cases pending against the petitioner and he is a habitual offender, I am not inclined to grant anticipatory bail to the petitioner.
