ORDER : The Court made the following order :- The petitioner, who is arrayed as A1, apprehending arrest at the hands of the respondent police for the offences punishable under section 379 of IPC and Section 21(4) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.80 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. CRL OP(MD). No.6697 of 2020 4.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that there are fifteen previous cases pending against the petitioner and he is a habitual offender. 5.This is the second application and there is no change of circumstances to entertain this application. Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate(Criminal Side) that there are fifteen previous cases pending against the petitioner and he is a habitual offender, I am not inclined to grant anticipatory bail to the petitioner.
