Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the 1st respondent to pass appropriate orders on the basis of petitioner's complaint dated 24.05.2012 with regard to cancellation of fraudulent registration and launching of prosecution as per the provision laid down by the Registration Act. ORDER
The petitioner's counsel informs this Court that the writ petitioner is no more and he seeks time to bring the legal heirs of the deceased petitioner on record. However, normally in such accommodation is given. In this case, I am of view that no purpose will be served because, the petitioner seeks cancellation of registration of certain documents on the ground that they have been fraudulently done. Such relief can be obtained only before the Civil Court. Filing of the writ petition is misconceived. The registering authority also cannot give the relief sought for. Hence, keeping open the petitioner's right, the Writ Petition stands dismissed. No costs.
