Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents to consider and pass orders in accordance with law on the petitioner's representation dated 26.11.2014, requesting the respondents to take necessary steps to prevent other department officials to enter into the TASMAC shop without the presence of the respondents 3 and 4 respectively within a time frame as may be fixed by this Court.

ORDER

The petitioner herein, claimed to be the member of the TASMAC Employees Association, has sought for mandamus to direct to the respondents to consider and pass orders in accordance with the law on the representation dated 26.11.2014 and to prevent the officials of other department from entering TASMAC shop without the presence of respondents 3 and 4.

2.The representation of the petitioner Association, dated 26.11.2014, indicates that many persons visit and inspect the TASMAC Shops. They threaten the employees and extract money from them. The people, who were not familiar with accounts, come and verify the accounts with wrong information. Therefore, whenever, the officials of other departments, like Customs Prohibition and Labour department want to inspect TASMAC Shop, they should come along with the officers attached to District TASMAC Office. 3.The very request made by the petitioner Association itself is prayer camouflage to prevent the surprise visit by law enforcing agency. The petitioner herein, in order to avoid being get caught for their misdeed, has approached this Court with untenable prayer. Considering the fact that the petition being filed by the Association on some wrong advice, writ petition is dismissed without costs.
