This petition has been filed to call for the records of the Impugned Communication of the 3rd respondent in Na Ka.No.5417/2025 dated 11. 11.2025 and quash the same as devoid of merits consequently directing the 3rd respondent to direct the respondents No.4 and 5 to do proper survey to identify and locate the lands in Corporation Ward No.AV, Block No.0013, TS.No.32/1A14 an extent of 2400 Sq.ft, Reddynagar Plot No.23, in Kottapattu Village, Tiruchirappalli East Taluk, Tiruchirappalli District as per the Town Survey Land Register, Town Survey Field Register, Town Survey Sketch issued by the 5th respondent, within the period as stipulated by this Court.

2. The respondents 1 to 5 have rejected the survey request, stating that the total extent of the land measures 150.9 metres and already comprises 12 plots, not 14 as claimed. Further, while the petitioner has submitted a sketch showing a total extent of 163.0 metres, the respondents 1 to 5 have surveyed the property only to an extent of 150.9 metres. It is contended by the respondents that the petitioner is suppressing material facts and is seeking a re-survey of the land.
3. The learned counsel for the petitioner submitted that, at the time of purchase, the property was measured in accordance with the sketch provided. Further, the petitioner relies upon the rough sketch to substantiate the claimed extent of the property as hereunder:- 4/9

4. Hence, the petitioner requested that the said land be surveyed by the respondents using scientific methods.
5. Considering the rival submissions, this Court is of the opinion that there is a possibility that the land comprises 12 or 13 plots, and that some encroachment may exist. The claim of 14 plots on the ground is not substantiated at this stage and requires proper ascertainment through a survey.
6. Therefore, this Court directs Respondents 1 to 5 to issue notice to the petitioner as well as the rival claimants, including Respondents 6 to 8, and to conduct an enquiry. Thereafter, they shall survey the property using both scientific and manual methods. The said respondents shall also indicate whether any encroachment exists in respect of the plots. If encroachment is there liberty is granted to the petitioner to approach the competent Civil Court for appropriate relief and resolution of the dispute.The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures: a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is 6/9
to be conducted. The petitioner shall affix the signature by receiving the notice of survey.
b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.
c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
