PRAYER:Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, forbearing the respondents 1 and 2 from permitting the 3rd respondent and similar persons to run industrial establishment within the midst of residential places of Ayyanar Colony, Prithivi Nagar situated at Sithurajapuram Village, Sivakasi Taluk, Virudhunagar District and consequently direct the respondents 1 and 2 to initiate appropriate action as against the 3rd respondent and similar Industrial Establishment for using heavy 1/4

vehicles for their transportation through the narrow street available for Prithivi Nagar, Ayyanar Colony situated at Sithurajapuram, Sivakasi Taluk, Virudhunagar District by considering the representation of the petitioner dated 17.02.2025. ORDER

(Order of the Court was made by J.NISHA BANU, J.) Heard Mr.P.Gunasekaran, learned counsel for the petitioner and Mr.P.Thilak Kumar, learned Government Pleader for the respondents 1 and 2. Considering the nature of the order proposed to be passed in this writ petition, notice to the third respondent is dispensed with. 2.By consent, this writ petition is taken up for final disposal at the stage of admission itself.

3.The petitioner has submitted a representation dated 17.02.2025 seeking to forbear the respondents 1 and 2 from permitting the third respondent or any other person to run an industrial establishment in the midst of the residential area of the petitioner's locality. Since the said representation was not considered till date, the present writ petition is filed. 2/4

4.The learned Government Pleader appearing for the respondents, on instructions, submits that on considering the representation of the petitioner, necessary proceedings were initiated and notice was also issued to the third respondent.

5.Considering the above said submission, this writ petition is disposed of with a direction to the respondents 1 and 2 to complete the proceedings initiated by them and pass appropriate orders by giving an opportunity of hearing to the petitioner as well as the third respondent within a period of twelve (12) weeks from the date of receipt of a copy of this order.
