ORDER
The petitioner challenges the order of the respondent on the ground that the impugned order came to be passed without affording an opportunity to the writ petitioner.
2. I have heard Ms.A.Ajitha, learned counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondent.
3. The learned counsel for the petitioner would invite my attention to the impugned order passed by the respondent, where, the application of the petitioner has been rejected on the ground that there is no connecting documents or title documents have been filed.
4. The learned counsel for the petitioner would submit that without providing an opportunity to the petitioner to produce necessary documents, the application of the petitioner has been rejected summarily. 2/5
5. I am satisfied that the impugned order has been passed without conducting any enquiry or giving an opportunity to the petitioner. In view of the above, the impugned order is set aside and the matter is remitted to the respondent for fresh consideration. The petitioner shall give a detailed representation enclosing the copy of this order and upon such representation being given by the petitioner, the respondent shall conduct an enquiry, hear the petitioner and who shall rely on all necessary relevant documents, thereafter, the respondent shall pass final orders on merits, in accordance with law.
6. In view of the above, the writ petition is allowed. No costs. Consequently, connected miscellaneous petitions are closed. No costs. Index : Yes / No NCC : Yes / No 20.03.2025 am 3/5
