O R D E R

This Writ Petition has been filed for a direction to the respondents to purchase the honey from the members of the fourth respondent - Society for the year 2025, with the moisture of 70 percentage to 76 percentage and following the quantities and other conditions fixed as per the guidelines issued by the third respondent in Na.Ka.No.12/2022/C1, dated 04.04.2024, by considering the petitioner's representation dated 05.02.2025.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.When the matter was taken up for hearing, the learned counsel for the petitioner submitted that the petitioner is a member of the fourth respondent Society, which is under the administrative control of respondents 1 to 3 and governed by the Society's bye-laws and the Tamil Nadu Cooperative Societies Act, 1983. The third respondent Society passed Resolution No. 7/2024-2025, dated 09.12.2024, fixing the total quantity of honey to be purchased from members for the year 2025 at Rs. 1,50,000/- and to purchase the honey having moisture of 76%. The petitioner contends that since the third respondent did not issue separate guidelines for the year 2025 on the quantity of honey to be purchased from the members, they have to follow the earlier guidelines dated 04.04.2024.

However, the third respondent did not fix the quantity of honey to be purchased from the members based on the duration and quantity of previous supply. In this regard, the petitioner has submitted a detailed representation on 05.02.2025 before the respondents, requesting them to purchase the honey with moisture content between 70% and 76%. The learned counsel further submitted that it would suffice if the third respondent is directed to consider and dispose of the petitioner's representation dated 05.02.2025, in accordance with law, within a time frame.

4.Considering the limited scope of the prayer now sought for by the petitioner, there shall be a direction to the third respondent to consider the petitioner's representation dated 05.02.2025 and pass appropriate orders solely on its own merits and in accordance with law, after giving due opportunity to the petitioner, as well as all other persons, who may be interested in the subject matter, within a period of two weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the fourth respondent to consider the same on its own merits.

5. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. 19.03.2025 Index : Yes / No Internet : Yes / No PKN Note: Issue order copy today.
