ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.5, in Crime No.419 of 2017 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(b), 294(b), 468, 420, 406 and 506(i) of I.P.C., and hence, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent/State.

3. The case of the prosecution is that the petitioner is the wife of A1 and the de-facto complainant is the sister of A1 and there was some family dispute in respect of the house property which belongs to the de-facto complainant and the first accused, who is the husband of the present petitioner/A5 is alleged to have received huge amounts by making false lease agreement.

4. The learned counsel for the petitioner would submit that the present petitioner is the wife of A1 and she has not committed any offence as alleged by the prosecution and A1 was already arrested.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before https://hcservices.ecourts.gov.in/hcservices/

the learned Judicial Magistrate No.V, Madurai and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
