This Writ Petition has been filed in the nature of a Mandamus seeking a direction to the first respondent to renew the passport of the petitioner bearing No.F1180290 for which application in File No.MD1074391563722, dated 12.07.2022 had been filed by the petitioner herein.

2.Heard Mr.M.Boopathi Pandiyan, learned Counsel for the petitioner, Mr.Raja Simman, learned Counsel for the first respondent and Mr.J.Ashok, learned Additional Government Pleader for the second respondent.

3.When the petitioner sought renewal of the passport, it was informed that FIR in Cr.No.109 of 2003 had been registered against the petitioner under Sections 294(b), 323, 506(ii) IPC. 4.It had been stated by the learned Additional Government Pleader, who taken notice on behalf of the second respondent, that the matter is now pending before the learned Judicial Magistrate, Ilayankudi, Sivagangai District in S.T.C.No.45 of 2013.

5.The learned Counsel for the petitioner stated that the petitioner had appeared before the said Court.

6.Let the petitioner give an affidavit that he would continue to appear on all hearing dates before the said Court and also give necessary undertaking that he would inform the Court, if he is to ever go abroad and the first respondent may issue a fresh notice to the petitioner, get necessary undertaking and an indemnity and thereafter, if the petitioner is otherwise eligible, renew the passport. The entire exercise may be completed within a period of three weeks from the date of receipt of a copy of this order.
