For Respondent : R.Anandharaj, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the Petitioners on bail in the event of his arrest in connection with a case in Cr.No. 807 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 323, 324 and 506(ii) of I.P.C., in Crime No.807 of 2020 on the file of the respondent police, seek anticipatory bail.

3. The petitioners are Accused Nos.1 and 2 and the allegation against them is that they attacked the de-facto complainant with aruval, due to rivalry in the milk trade.

4. The learned Additional Public Prosecutor states that the second petitioner has already been secured and remanded to judicial custody.

5. As far as the first accused is concerned, from the F.I.R., I find that there is a overt act against him. Therefore, I am not inclined to grant anticipatory bail to the first petitioner, though the learned counsel for the petitioners states that it is a case in counter and the injured person has already been discharged from the hospital.

6. Considering the gravity of the enmity between two groups, this anticipatory bail petition is dismissed in respect of the first petitioner and this petition is dismissed as infructuous in respect of the second petitioner.
