Respondents PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to consider and pass suitable orders on the petitioners representation dated 09.02.2026 seeking appropriate action to ensure continuous and smooth functioning of the school 4th respondent school, and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

O R D E R
1. Heard Mr. E.V.N. Siva, learned counsel for the petitioner, and Mr. N. Ramesh Arumugam, learned Government Advocate appearing for respondents 1 to 3. The materials available on record have also been perused.
2. The petitioner apprehends that, based on the decree for declaration of title and recovery of possession, the respondent authorities are likely to close the school without following the procedure contemplated under Section 29 of the Tamil Nadu Private Schools 2/6
(Regulation) Act, 2019. However, the closure of the school is pursuant to a decree passed by a competent civil court, and therefore, the question of invoking the said statutory procedure does not arise. The petitioner has further expressed concern that, upon closure of the school, her service conditions may be affected. However, it is seen that in the representation submitted by the petitioner, no request has been made seeking absorption in an alternative school. Hence, the present Writ Petition is not maintainable in its current form.

In view of the above, this Writ Petition is disposed of, granting liberty to the petitioner to submit a fresh representation to respondents 1 to 3 seeking absorption of her services in an alternative school. Upon receipt of such representation, respondents 1 to 3 shall consider the same on its own merits and in accordance with law, and pass appropriate orders within a period of two (2) weeks from the date of receipt of the representation. It is further made clear that, while considering the petitioner's case, the respondents shall also take into account the absorption of other staff members and the accommodation of students in appropriate alternative schools.
