O R D E R

(Order of the Court was delivered by G.R.SWAMINATHAN, J.) The petitioner was convicted and sentenced by the trial court in S.C.No.190 of 2023 on the file of Principal District and Sessions Judge, Ramanathapuram for the offences under Sections 465 IPC, 465 r/w. 120B IPC and 12(1A(a) of Indian Passport Act. He had been sentenced to two years rigorous imprisonment for the offence under Section 465 IPC and three years rigorous imprisonment for the offence under Section 12(1A)(a) of Indian Passport Act and two years rigorous imprisonment for the offence under Section 465 IPC r/w. Section 120(B)IPC. He had obtained suspension of sentence before the court below.

2. We are satisfied that the petitioner has an arguable case on merits. Accordingly, this petition is ordered and the imprisonment ordered by the trial Court through the impugned judgment is suspended subject to the following conditions:- (i)The petitioner shall execute a bond for a sum of Rs.25,000/-, with two sureties, of whom, one should be a 2/4

3 CRL.M.P.(MD)NO.5893 OF 2026 blood relative, each for a like sum to the satisfaction of the Principal District and Sessionss Judge, Ramanathapuram; (ii)The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; and (iii)The petitioner shall appear before the concerned Court on the first working day of every month until further orders and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.
