(Crime No.1 of 2016) .. Respondents

PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the second respondent to secure the accused who are arrayed as Accused in Crime No.1 of 2016 for the offences under Section 406 and 420 I.P.C. and Section 5 of TNPID Act, 1997 on the file of the second respondent within the stipulated time as fixed by this Court.

For Petitioners in both cases : Mr.T.Lajapathi Roy For respondents in both cases : Mr.B.Pugalendhi, Additional Advocate General assisted by Mr.P.Kannithevan Government Advocate (Criminal side) COMMON ORDER Both the Criminal Original Petitions are filed to direct the second respondent to secure the accused who are arrayed as Accused in Crime No.64 of 2015,dated 05.12.2015 and the accused who are arrayed as Accused in Crime No.1 of 2016 respectively. 2.Heard the learned counsel for the petitioners and the learned Additional Advocate General assisted by the Government Advocate (Crl. Side) for the respondents.

3. The learned Additional Advocate General would submit that the company viz., Pariwar Diary has collected deposits from more than 1,67,000 persons and to the tune of Rupees Two Hundred Crores in Tamil Nadu and the case has been registered against the Company as well as the directors by the District Crime Branch as well as the Economic Offences Wing, Madurai and there is a propose to transfer the case from District Crime Brnah to Economic Offences Wing. It is further submitted that three employees have been arrested so far and a special team has been formed to secure the main accused. The police have also attached the landed property to an extent of 50 acres situated at Vadipatti and 50 acres in Bangalore and they have initiated steps to attach the other properties.

In view of the above submission, the petitioners are directed to appear before the Inspector of Police, Economic Offences Wing-II, Madurai District along with relevant documents and extend their co-operation. On appearance of the petitioners with relevant documents, the Inspector of Police, Economic Offences Wing-II, Madurai District shall consider the case and take necessary action on merits and in accordance with law.

5. With the above observations, both the Criminal Original Petitions are closed.
