PRAYER :- For Bail in Crime No.277 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole accused, who were arrested on 06.04.2021 for the offences under Sections 341, 452 and 353 of IPC, Section 3(1) of TNPPDL Act and Section 25(1)(a) of Arms Act, 1959, in Crime No.277 of 2021 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 06.04.2021 at about 03.05 p.m., the petitioner entered into the election booth at Panchathi Alangudi Government Panchayat Union Primary School with aruval without wearing shirt. When, the de-facto complainant was prevented the petitioner, the petitioner attacked the election voting machine with aruval two times and broke it. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is a villager and he did not wear shirt, except this allegation, no overt act is attributed against him. He would further submit that the petitioner is an innocent and he is in jail for more than 15 days, hence he may be granted bail. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.5777 of 2021 4.The learned Government Advocate(Crl.Side) appearing for the respondent opposed the bail petition stating that this is a serious offence and the petitioner was interfering into the election process.

5.It is seen from the submission made that the petitioner had entered into the election booth without wearing shirt and broken the election voting machine with aruval and prevented the Government servant from performing their election duty. The act of the petitioner amounts to interference with the election process and also preventing the Government servant from performing their election duty. Considering the seriousness of the offence, this Court is not inclined to grant bail to the petitioner. 6.In the result, the petition stands dismissed. sd/- 22/04/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
