ORDER
The above petition has been filed seeking orders to condone the delay of 315 days in filing the appeal, challenging the award dated 28.04.2018 passed in 1/3
M.C.O.P.No.598 of 2015 on the file of the Motor Accident Claims Tribunal / Special Sub Court, Tiruchirappalli.
2. It is seen from the records that this Court vide order dated 29.07.2019 has passed a conditional order directing the petitioner to pay cost of Rs.1,000/- for allowing the above petition. Since the cost was not paid, C.M.P.(MD)No.5405 of 2019 was ordered to be dismissed for default. The petitioner has then filed a petition in C.M.P.(MD)No.8184 of 2024 seeking orders to set aside the dismissal order dated 29.07.2019 and restore the said petition and this Court vide order dated 05.07.2024 allowed the petition and ordered for restoring of the petition.
3. It is not in dispute that the petitioner has already paid cost of Rs.1,000/- to the Legal Services Committee attached to this Bench, which came to be recorded vide order dated 05.07.2024 itself. Hence, this petition is ordered. The Registry is directed to number the appeal, if it is otherwise in order and list it for admission in the usual course.
