O R D E R
This petition has been filed to direct the 2nd and 3rd respondents herein to take immediate action in pursuance to the letter dated 03.01.2017 and pass suitable orders on the basis of the petitioner representation dated 27.03.2017 and within the time stipulated by this Court.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.
3. Today, Mr.S.Paranjothi, Special Sub Inspector of Police, Anti Land Grabbing Special Cell is present before this Court. https://hcservices.ecourts.gov.in/hcservices/
4. When the matter was taken up for hearing, the learned Government Advocate, on instructions submitted that on the complaint given by the petitioner, an enquiry was conducted and the same was closed on 03.01.2017 with a direction to the Revenue Divisional Officer to decide the dispute.
5. In view of the judgment of this Court in Sugesan Transport Pvt. Ltd., v. the Assistant Commissioner of Police, J2 Adyar Police Station, Chennai and another reported in 2016(5) CTC 577, this petition is not maintainable. In the considered opinion of this Court, the police have no authority to direct the Revenue Divisional Officer to decide the civil disputes. It is for the parties to approach the civil Court and establish their title.
6. In view of the above, this petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
