ORDER
The present petition has been filed by the first accused in STC.No.589 of 2027 on the file of the learned Judicial Magistrate, Aranthangi, to quash the charge sheet wherein the charge sheeted offences under Sections 143 and 283 of IPC/189(2) and 285 of BNS, 2023.
2. A perusal of the charge sheet reveals that the petitioner, along with the 6 others, had unlawfully assembled without any prior permission from the police and raised slogans that the textile mill employees should be made permanent.
3. According to the learned counsel for the petitioner, the petitioner and the others only expressed their opinion that the Textile Mill Employees should be made permanent and prayed for quashing the proceedings as against the petitioner.

Considering the allegation made in the charge sheet as against the petitioner, it is clear that the petitioner, along with the others have exercised only their democratic right to peacefully protest for not making the textile mill employees permanent and there is no allegation of any harm caused to anyone 2/4
and in the said circumstances, the petitioner cannot be charged with the offences under Sections 143 & 283 of IPC.
5. In view of the above, the charge sheet in S.T.C.No.589 of 2023 on the file of the learned Judicial Magistrate, Aranthangi, is quashed as against the petitioner/A1 alone and the Criminal Original Petition stands allowed.
