ORDER : The Court Made the following order :- The petitioners/accused 1 to 3 who were arrested and remanded to judicial custody on 02.06.2017 for the offence under Sections 294 (b), 353, 506(ii) of IPC and Section 3 of Tamil Nadu Medicare Service Persons and Medicare Service Institutions (Prevention of Violence and Damage or Loss to the Property) Act, 2008 in Crime No.271 of 2017 on the file of respondent/Police, seek bail. 2.The case against the petitioners is that based on the complaint given by the DMO, Government General Hospital, Devakottai, alleging that three unknown persons came to the hospital in a drunken mood and damaged the hospital entrance and also prevented the Doctor in duty from discharging his function, used abusive language and threatened to throw petrol bomb, these three petitioners were apprehended on 02.06.2017 by identifying them through the CCTV footage of the hospital.

3.The case of the petitioners is that on 01.06.2017, the 3rd petitioner sustained injury in a road accident. So, the other two petitioners took him to the hospital. Since there was no one to attend the injured person, they questioned about the nonavailability of Doctors. Infuriated by that, a false complaint has been given against the petitioners.

4.The learned Additional Public Prosecutor appearing for the respondent/Police submits that the complaint in fact was given against three unknown persons and only through the CCTV footage of the hospital, the identity of the petitioners were able to be ascertained. The CCTV footage totally confirms the content of the complaint.

5.Since the petitioners entered into the hospital in a drunken mood and has caused panic in the hospital where the patients are taking treatment, this Court is of the view that these petitioners do not deserve for bail.
