ORDER : The Court made the following order :- The petitioner/A.1, who apprehends arrest for the alleged offences under Sections 399 and 402 IPC in connection with NonBailable Warrant issued in S.C.No.9 of 2017, on the file of the learned V Additional District and Sessions Judge, Madurai, in Crime No.311 of 2004, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and other accused waylaid the de-facto complainant and demanded money from him by showing weapon. Hence, the complaint.
3.Admittedly, Non-Bailable Warrant (NBW) is pending against the petitioner from 15.03.2022 and the petitioner has not approached the trial Court to recall the warrant pending against him. Without availing the alternative remedy available before the trial Court, he has chosen to approach this Court directly.
