Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to delete the name of the fifth respondent from the joint patta No. 7079 by cancelling the patta issued in favour of the fifth respondent and to issue separate patta to the petitioners in respect of the property in Survey No. 234A/27 and 234A/28, Amathur Village, Virudhunagar Taluk, Virudhunagar District.

ORDER

Heard the learned counsel appearing for the petitioners and the learned Additional Government Pleader appearing for the official respondents. Considering the nature of relief to be granted, issuance of notice to the private respondent is dispensed with. 2.The petitioners' case is that the name of the fifth respondent was illegally incorporated in the petition mentioned patta. The petitioners seek deletion of the name of the fifth respondent. 2/4

3.The third respondent is directed to enquire into the petitioners' representation and after issuing notice to the fifth respondent, pass an appropriate order on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. I make it clear that I have not gone into the merits of the matter. 4.This writ petition is disposed of accordingly. There shall be no order as to costs.
