ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, challenging the impugned order passed by the third respondent.

2. The learned Additional Government Pleader appearing for the respondents 1 to 3 submitted that based on the order passed by this Court, one Srinivasan has preferred an appeal before the Revenue Divisional Officer and the same is pending.

3. The learned Counsel appearing for the petitioner submitted that he is the owner of the property and is in possession and that he is trying to put up a construction. However, the fourth respondent is objecting to the same and is also claiming title over the property. When the petitioner received objections, he enquired before the Revenue Authorities, and only thereafter he came to know about the proceedings dated 26.10.2010 issued by the third respondent. In the impugned proceedings, the third respondent has restrained both the petitioner and 2/5

three other individuals, namely, Srinivasan, Sivaramakrishnan and Balasubramaian. The present fourth respondent is the son of Sivaramakrishnan.

4. It is seen that the petitioner has filed a petition seeking cancellation of the classification as natham land and for issuance of a patta. In turn, the impugned order was passed, but no proper enquiry was conducted by the respondents, thereby violating the Principles of Natural Justice.

5. In view of the above, the impugned order is quashed. The Tahsildar / third respondent is directed to conduct an enquiry after issuing notice to the petitioner, fourth respondent, Srinivasan and Balasubramaian and thereafter, pass appropriate orders within a period of three (3) months from the date of receipt of a copy of this order.

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
