To call for records and set aside the order passed by the learned Judicial Magistrate, Manapparai in Crl MP(MD).NO.407 of 2019 in STC.NO.3183 of 2016 dated 25/02/2019 in respect of dismissing the petition filed by the petitioner under section 311 of Cr.P.C. For recalling of PW1 for the examination within a time frame fixed by this Hon'ble Court by allowing this petition and thus render justice.

ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.K.Sivabalan, Advocate for the Petitioner and of Mr.A.Joel Paul Antony, for the respondent, this Court made the following order:

When the matter is taken up for hearing today, the learned counsel for the respondent would submit that the case in S.T.C.No.3183 of 2016 was disposed of by the learned Judicial Magistrate, Manapparai, vide order Judgment dated 20.05.2022 and hence, the prayer sought for in this petition has become infructuous.
