ORDER

[Order of the Court was made by The Hon'ble The CHIEF JUSTICE] We have heard Mr.Niranjan S.Kumar, learned counsel for the petitioner, Mr.S.P.Maharajan, learned Special Government Pleader for the respondents 1 and 2 and Mrs.K.R.Shivashankari, learned counsel for the respondent No.3.

2. The contention is that notices under Sections 6 and 7 of the Tamil Nadu Land Encroachment Act, 1905 are issued without measuring the property or surveying the property.

3.The learned Special Government Pleader, on instructions, submits that decision has been taken by the authority to measure/survey the property on 29th November, 2023.

4.The petitioner and the impleaded party may remain present on 29th November 2023 on the site. The authority may measure/survey the property. Pursuant to the measurement/survey, further steps may be taken by the authority in accordance with law. As fresh measurement is to be undertaken, the notices issued under Sections 6 and 7 of the Tamil Nadu Land Encroachment Act, 1905 stands set aside. If after measuring/surveying, encroachment is found, then the respondent may resort to the provisions of the Tamil Nadu Land Encroachment Act, 1905.

5. The writ petition stands disposed of accordingly. However, there shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
