ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1, 2, 4 & 5 in Crime No.4 of 2017 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 417, 376 and 506(i) of I.P.C., and hence, seek anticipatory bail.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondent/State.

3. The case of the prosecution is that A1 fell in love with the de-facto complainant and given a false promise to marry her, had a sexual relationship with her and on pregnancy, refused to marry her and the other petitioners have threatened the de-facto complainant.

4. The learned counsel for the petitioners would submit that the de-facto complainant already married one Veerabathiran, who is none other than the son of her maternal uncle and she was not obtained legal divorce. He would further submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Kamuthi, Ramanathapuram District and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
