Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to transfer the investigation in Crime No. 7 of 2016 on the file of the Inspector of Police, All Women Police Station, Kumbakonam, Thanjavur District to the 2nd respondent herein or any other Police Officer, within the District.

O R D E R

This Criminal Original Petition has been filed seeking to transfer the investigation.

2. The grievance of the petitioner is that the petitioner is the defacto complainant who gave a complaint before the 3rd respondent police. Eventhough, the crime number has been registered in the year 2016, the 3rd respondent police did not conduct any investigation and so far final report has not been filed.

3. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents-1 to 3, based on instructions submitted that already investigation has completed and final report has been filed before the Judicial Magistrate No.II, Kumbakonam and the same has been taken on file as C.C. No. 273 of 2017.

4. In view of the fact that already investigation has completed and final report has been filed before the concerned Court. At this stage, the relief sought for by the petitioner cannot be granted.

5. With the above observations, this Criminal Original Petition stands dismissed.
