ORDER

Seeking direction to the respondents 3 and 4 not to interfere with the civil dispute relating to the land comprised in S.No.50/6A for an extent of 0.40.50 ares and in S.No.50/6B for an extent of 0.76.00 Ares situated at Pudupatti Village, Dindigul East Taluk, Dindigul District, this writ petition is filed. 2.Since no adverse order is likely to be passed against the fifth respondent, notice to her is dispensed with.

3.The learned counsel for the petitioner submitted that already a civil case in O.S.No.240 of 2025 is pending on the file of the learned Additional District Munsif Court, Dindigul, with respect to the properties mentioned supra and the fifth respondent is a party to the said civil suit. In the interregnum, it is seen that the fifth respondent had approached this Court and managed to file a writ petition in WP(MD).No.195 of 2026, seeking to direct the respondent 2/6

police to take action against the petitioner herein and others. This Court, by order dated 12.01.2026, had directed the respondent police to consider the representation of Amalakkal, fifth respondent herein. Pursuant to the same, the respondent police are subjecting the petitioner to harassment and unnecessarily they are meddling in a civil dispute, which is already seized of by the learned Additional District Munsif Court, Dindigul.

4.The learned Additional Public Prosecutor submitted that only pursuant to the receipt of the order of this Court in W.P(MD).No.195/2026, dated 12.01.2026, for the purpose of conducting enquiry, the petitioner was called. 5.The learned Government Advocate categorically submitted that the petitioner as well as the fifth respondent hold separate lands under various patta numbers and that they are also in possession of valid pattas. That apart, several civil disputes are also pending between both the parties. It is only for the civil Court to take a final call on the same.

6.Heard the learned counsel on either side and carefully perused the materials available on record.

7.Taking cue from the submission made by the learned Government Advocate, it is clear that only the civil Court can resolve the dispute between the parties. Hence, the fourth respondent police is directed not to meddle in the civil matter. The parties to work out the remedy before the pending civil suit or by filing any fresh suit.
