ORDER

Seeking to direct the first respondent not to harass the petitioner under the guise of enquiry on the basis of the complaint lodged by the second respondent, this writ petition is filed. 2.Since no adverse order is going to be passed against the respondents 2 to 4, notice to them is dispensed with. 3.The learned counsel for the petitioner submitted that the second respondent has lodged a complaint before the first respondent police, for which, the first respondent police is continuously harassing the petitioner.

4.The learned Government Advocate(crl.side), on instructions, submitted that at the instance of the second respondent, already first information report in Crime No.48 of 2026 has been registered on 27.02.2026 as against the petitioner for the offences under Sections 296(b), 115(2) and 351(2) of BNS, 2023 and after registering the same, the petitioner was not called for enquiry. However, another complaint has 2/5

been received from the neighbour of the petitioner with respect to the quarrel which had erupted between the petitioner and his neighbour and only in that regard, the petitioner was required to appear before the respondent police.

5.Heard either side and carefully perused the materials available on record.

6.Since the investigation with respect of the First Information Report in Crime No. 48 of 2026, which was registered at the instance of the second respondent, has not yet been concluded, and as another enquiry has been initiated against the petitioner at the instance of his neighbour, the first respondent police had required the petitioner to appear before them In view of the same, the first respondent police is directed to require the petitioner to appear before them only on issuance of summons under Section 64 of BNSS and if any summon as directed above is received by the petitioner, the petitioner is directed to co-operate for enquiry.
