Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records of the impugned rejection order passed by the 2nd respondent in application no.2025/N105/26/483970 dated 29.12.2025 and quash the same as illegal and consequently direct the 2nd respondent to issue patta for the property in Doc.No.272/2010 based on the petitioner's application dated 28.11.2025 in 2025/N105/26/483970 within the stipulated time.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned rejection order passed by the 2nd respondent in application No.2025/N105/26/483970 dated 29.12.2025 as illegal and consequently, to direct the 2nd respondent to issue patta for the property in Doc.No.272/2010 based on the

petitioner's application dated 28.11.2025 in 2025/N105/26/483970 within the stipulated time. 2.The petitioner has purchased the property in Survey No.715 through sale deed and applied for issuance of patta. The same was rejected through the impugned order stating that the petitioner has not stated the correct survey number.

3. The learned Counsel appearing for the petitioner submitted that initially, the survey number was assigned as Survey No.715 and subsequently re-numbered and subdivided as 1372/17. The said information was furnished by the 3rd respondent. Therefore, he has submitted the application with the new subdivided survey number in the application but the respondents have rejected the application through the impugned order stating that the survey number differs. When the subdivision records and the correlation is available with the Tahsildar and the respondents cannot decline simply by stating that the survey number is not coinciding.

4.Therefore, the impugned order is quashed and the respondents are directed to conduct an enquiry and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
