ORDER

This writ petition has been filed seeking a direction to the first respondent to dispose of the petitioner's appeal dated 14.10.2015, in the light of the G.O.2D.No.10 dated 06.01.2014 passed for the similarly placed employee and in the light of the recommendations made by the third respondent vide proceedings dated 09.12.2023 in Na.Ka.No. A2/24836/2015 and thereby empanel the petitioner in the 2011 panel for the promotion to the post of 'Assistant' and confer him all the benefits both service and monetary.

2. Heard the learned counsel on either side.

3. The petitioner's father was working as 'Village Assistant' and he died in harness on 03.10.1999. The petitioner, on compassionate grounds, was appointed by the third respondent to the post of 'Typist' on 07.09.2007 and now, he has been in the post of Revenue Inspector from the year 2015. Even though he was appointed in the year 2007, he was regularized in the year 2014 only and the said delay is on the part of the officials only. 2/4

4. The case of the petitioner is that when the panel for promotion was prepared for the year 2011, his name was not included in the list because of regularization delay. One Sasikumar, who is a similarly placed person, had the benefit of promotion in 2010 panel. Hence, the petitioner filed an appeal dated 14.10.2015 before the first respondent, which is still pending. Hence, the petitioner came before this Court by way of this writ petition.

Considering the facts and circumstances of this case, this Court directs the first respondent to consider the petitioner's appeal dated 14.10.2015, on its own merits and pass appropriate orders in accordance with law, within a period of three months from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

6. With the above observations and directions, the Writ Petition stands disposed of. There shall be no order as to costs. 26.06.2025 NCC : Yes/No Index : Yes / No sm 3/4
