ORDER
This Criminal Original Petition has been filed by the petitioner, to call for the records for the First Information Report in Crime No.44 of 2015 dated 21.01.2015, on the file of the 1st respondent police and quash the same as illegal and devoid of merits.
2.Heard Mr.M.Jegadeesh pandian, learned counsel appearing for the petitioners and Mr.K.Anbarasan, learned Government Advocate (Crl.Side) appearing for the respondent/Police. https://hcservices.ecourts.gov.in/hcservices/ 3.A Criminal case has been registered against the petitioners under Sections 294(b),324,506(ii) & 120(B) of IPC. The
de-facto complainant and the accused have filed a compromise memo, dated 27.6.2017 before this Court. The present Criminal Original Petition is filed to quash the FIR in Crime No.44 of 2015, pending before the first respondent in view of the compromise memo. 4.This Court has gone into the complaint as found in the FIR and the Compromise. The parties, namely the De-facto complainant and the accused are present before this Court. They have also vouched to the effect that they have signed the compromise memo on their own volition and free will. The identity of the persons who have signed the compromise memo also checked out and verified to be genuine.
5.Having regard to the nature of allegations as found in the FIR and considering the compromise memo filed by both the Parties, this Court is of the view that no useful purpose will be served in keeping the matter pending and no further enquiry is required in the criminal case.
6.Hence, recording the compromise memo filed by both parties, the Criminal Original Petition is allowed and the entire proceedings in Crime No.44 of 2015, dated 21.01.2015 on the file of the 1st respondent police, in respect of the Petitioners alone, is quashed. The Compromise memo shall form part of the order of this Court.
