ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to remove the name of the third respondent from Patta No.15510 relating to S.R. No. 6/38, situated at Midalam A Village, Killiyur Taluk, Tholaiyavattam Post, Kanyakumari District, based on the petitioner's representation dated 05.03.2024.

2. Heard the learned counsel appearing for the parties.

According to the petitioner, he is the lawful owner/entitled person in respect of the property covered under Patta No.15510 relating to S.R.No.6/38, situated at Midalam A Village, Killiyur Taluk, Tholaiyavattam Post, Kanyakumari District. The name of the third respondent has been erroneously included in Patta No.15510, despite the third respondent having no valid right, title, or interest in the said property. Hence, the petitioner submitted a representation dated 05.03.2024 to the first respondent seeking removal of the third respondent's name from the patta. Since the same has not been considered so far, the petitioner has

approached this Court by filing the present Writ Petition for the relief stated supra.

4. The learned Additional Government Pleader appearing for the respondents 1 and 2 submits that the petitioner's representation dated 05.03.2024 will be considered on merits and in accordance with law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 05.03.2024, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioner, the third respondent, and any other persons, who may be affected by such decision, within a period of four weeks from the date of receipt of a copy of this order. Needless to state, the adjudication of the Civil Court shall also be taken into account while passing such orders. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.)
